Court Dismiss Sacked APC LG Chairmen Petition, Awards Fine To Petitioners, Lawyer

The Federal High Court sitting in Osogbo has dismissed a lawsuit filed by sacked local government chairmen on Monday, 20 January 2025.

This development comes ahead of the upcoming local government elections scheduled for 22 February.

The case, filed by chairmen elected during the APC-led administration, sought to restrain the state government from conducting new local government elections and distributing federal allocations.

The court, however, ruled against the claimants, allowing the elections to proceed as planned.

Presiding over the matter, the judge emphasised the importance of adhering to the rule of law.

“This decision reflects the judiciary’s commitment to upholding lawful governance and rejecting unfounded claims,” the judge stated during the ruling.

In addition to dismissing the suit, the court imposed penalties on the claimants and their counsel.

A fine of ₦1 million was levied against the lawyer representing the claimants, while the claimants themselves were collectively fined ₦200,000.

The court described the case as lacking in merit and reiterated that the plaintiffs failed to provide sufficient evidence to support their claims.

“The court will not entertain actions designed to obstruct due process,” the judge noted.

The dismissal has been lauded as a significant milestone in ensuring the smooth conduct of the February local government polls.

The Osun State Electoral Commission, OSSIEC, welcomed the ruling, reaffirming its readiness to conduct credible elections.

An official from OSSIEC commented, “We are committed to a free and fair electoral process, and this judgement clears any doubts about our mandate.”

Meanwhile, the sacked chairmen have yet to respond to the court’s decision.

Sources suggest that they may explore further legal options, although no official statement has been made.

The court ruling highlights the tension between the state government and former officeholders, a situation that has persisted since the administration of Governor Ademola Adeleke took office.

Observers say the upcoming local government elections will serve as a test of political stability and governance in Osun State.
