LG Crisis: Osun APC Rejects Court Verdict, Heads To Appeal Court Over Chairmen’s Tenure.

The All Progressives Congress (APC) in Osun State has rejected the judgment of the Federal High Court sitting in Osogbo on the tenure of reinstated local government chairmen and councillors, describing the ruling as a miscarriage of justice and announcing plans to challenge it at the Court of Appeal.

In a statement issued on Monday by the party’s Director of Media and Information, Mogaji Kola Olabisi, the APC said the judgment delivered by Justice Adefunmilola A. Demi-Ajayi dismissed a suit filed by the reinstated local government chairmen and councillors elected on October 15, 2022.

According to the party, the suit was instituted in September 2025, while several appeals arising from interlocutory rulings had already been filed and were being considered by the Court of Appeal in Abuja.

The APC noted that the appellate court heard the matter on June 3, 2026, and adjourned further hearing to September 28, 2026.

The party faulted the decision of the Federal High Court to proceed with judgment despite a pending motion seeking a stay of proceedings before the Court of Appeal.

“Notwithstanding the fact that the Court of Appeal has become seised of the matter and a motion for staying further proceedings by the lower court in the matter is pending at the Court of Appeal, the Judge went ahead and proceeded to give judgment today 15th June, 2026 where the suit was dismissed,” the statement read.

The APC said the court ruled that the tenure of the reinstated elected local government officials ended in October 2025.

According to the party, the implication of the ruling is that the local government election conducted by the Osun State Independent Electoral Commission (OSSIEC) on February 22, 2025, and the subsequent swearing-in of officials on February 23, 2025, lacked legal foundation.

“The implication is that the purported elections conducted by the Osun State Independent Electoral Commission on 22nd February, 2025 and the alleged swearing in of the people as elected officers on 23rd February, 2025 became a nullity having held that the tenure of office of the Plaintiffs subsisted till October, 2025,” APC stated.

The opposition party advised residents to disregard what it described as misleading interpretations of the judgment by the state government.

“Members of the public are hereby advised to be wary of the usual misleading information being peddled by the Osun State Government over the void elections and swearing-in purportedly done in February, 2025,” the statement added.

The APC further maintained that the reinstated chairmen and councillors would continue to function in office pending the determination of the appeal.

“Meanwhile, the reinstated Chairmen and Councilors shall put to test the judgment at the appropriate venue and until such constitutional rights are exhaustively exercised, the reinstated Chairmen and Councilors will continue to discharge their constitutional duties in the office,” the party said.

The party also called on law enforcement agencies to prevent any breakdown of law and order arising from the development and urged its supporters to remain calm while legal processes continue.

It should be noted that the chairmen and councillors of the APC have their constitutional right of appeal and they have exercised it by filing a notice of appeal together with a motion for stay of execution. No enforcement process can be commenced against them until the final determination of the appeal.

“We, therefore, urge the members of the public to exercise restraint and await the final determination of the appeal,” the APC stated.
